A4TE and Coalition of National and Grassroots Organizations to Condemn Marjorie Taylor Greene Bill H.R. 3492

[Washington, D.C.] - In response to H.R. 3492, which seeks to criminalize safe and evidence-based transition-related health care for trans and gender-diverse youth, Advocates for Trans Equality (A4TE) has brought together a coalition of over 160 national and grassroots organizations from multiple health equity movements, urging Congress to reject this bill. Introduced by Rep. Marjorie Taylor Greene, the legislation seeks to ban consensual transition-related health care for trans youth, while explicitly endorsing non-consensual surgeries on intersex infants - a contradiction that demonstrates the bill’s cruel ideological agenda. 

“This bill is barbaric, incoherent, and cruel. Although this bill claims to protect children, it only persecutes and endangers transgender, intersex, and gender-diverse (TGDI) youth.” said Sinead, Health Policy Analyst at A4TE. “Nearly every reputable medical association affirms that the care this bill seeks to criminalize is in fact safe, medically necessary, and evidence-based. Such positions from major medical organizations are rooted in over four decades of peer-reviewed scientific evidence – the very same types of evidence that the Trump administration and conservative lawmakers continue to dismantle through funding cuts for TGDI inclusive research, while at the same time driving misinformation about this care and TGDI people.”

“Decisions about medical care should be made by patients and their loving families, under the advisement and counsel of qualified and highly skilled medical professionals - not by politicians. This legislation would subject transgender and gender-diverse youth to severe psychological suffering by depriving them of this potentially lifesaving care which is proven to reduce anxiety, depression, suicidality, disordered, eating and substance abuse. It is just as cruel that this bill also endorses subjecting intersex infants, who cannot understand or consent to what is done to their bodies, to irreversible surgical procedures, the only purpose of which is enforce a rigid and unscientific idea of sex. The hypocrisy on display in this bill would be staggering, if it were not so obvious that the only purpose of this bill is to enforce outdated and unscientific stereotypes.”

“Word for word, this bill is packed with inflammatory, misleading, and extreme language, intended to stoke fear and spread misinformation about a field of care that has existed for over four decades. Every claim made within this bill regarding this long-standing and evidence-based field of medicine is refuted by a robust body of evidence, which has been drawn from over four decades of this care’s provision to transgender and gender-diverse adolescents. As concluded by the most rigorous systematic review to date on the subject, conducted by the Utah Department of Health and Human Services:

[P]olicies to prevent access to and use of gender-affirming care for treatment of gender dysphoria in pediatric patients cannot be justified based on the quantity or quality of medical science findings or concerns about potential regret in the future, and high-quality guidelines are available to guide qualified providers in treating pediatric patients who meet diagnostic criteria.

“This bill is extreme, overreaching, and explicitly discriminatory, distorting the intentions section of Title 18 of the U.S. Code, which prohibits Female Genital Mutilation (FGM). This bill distorts and exploits this section of the U.S. Code to deprive trans, gender-diverse, and intersex (TGDI) people of the bodily autonomy and access to care that ALL people deserve, regardless of their religion, race, ethnicity, class, country of origin, or political party. TDGI youth, their families, and the trained medical professionals that provide this care want nothing more than to ensure that TGDI youth can live authentically as themselves. That lawmakers pushing this bill show they do not take seriously their obligations to their constituents, to address real issues in our country such as skyrocketing health care costs, provider shortages, care deserts, and the continued dismantling of the U.S. Public Health infrastructure. When the mid-terms come, constituents will vote on their wallets. They will remember health care costs continue to skyrocket as federally funded coverage was slashed, while conservative lawmakers push a discriminatory ideological agenda at the expense our nation’s sickest and poorest.” 

A4TE sent a sign-on letter signed by over 160 national, state, and local organizations to Congress, urging all Members of Congress to reject H.R. 3492 and any attempt to legislate prejudice into health policy. The sign-on letter denounces Marjorie Taylor Greene’s bill as an extreme and discriminatory attempt to restrict care and criminalize providers for offering evidence-based treatment. If enacted, H.R. 3492 could impose prison sentences of up to 10 years and heavy fines on providers who offer transition-related care - despite this care being supported by every reputable medical association in the country. Simultaneously, the bill creates an exemption for invasive surgeries on intersex infants, effectively legalizing the very type of harmful conduct it falsely claims to oppose. The letter was delivered to all Members of the House of Representatives today.  

“This bill does not protect children - it persecutes them,” the letter states. “It criminalizes safe, evidence-based medical care for trans youth while endorsing irreversible, non-consensual surgeries on infants with intersex variations. H.R. 3492 is extreme, overreaching, and explicitly discriminatory. A fringe group of republicans have continued to obfuscate their lack of vision and failure to meet the needs of their constituents by constantly introducing discriminatory and dehumanizing legislation, aimed at TGDI people. This bill cannot be allowed to pass, because, without exaggeration, the health and safety of hundreds of thousands of people are on the line”
